1. Acceptance of Terms

By accessing or using ProtoBerd ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ProtoBerd is an AI-powered prototyping tool that generates web application code from natural language prompts. The Service uses large language models to produce code and provides an in-browser development environment for previewing generated applications.

3. Acceptable Use

You agree not to use the Service to:

• Generate malicious software, malware, or exploit code
• Attempt to circumvent rate limits or security measures
• Generate content that is illegal, harmful, or violates third-party rights
• Reverse-engineer, decompile, or extract the underlying AI models
• Use automated tools to scrape or bulk-access the Service
• Impersonate another person or misrepresent your affiliation

4. Intellectual Property & Generated Code

Your code is yours. You retain full ownership of all code generated through your use of the Service. ProtoBerd does not claim any intellectual property rights over your generated output. You are free to use, modify, distribute, and commercialize the code you create.

The ProtoBerd service itself, including its branding, UI, prompts, and underlying technology, remains the intellectual property of ProtoBerd.

5. Service Limitations

You acknowledge and agree that:

• AI-generated code may contain errors, bugs, or security vulnerabilities and should be reviewed before production use.
• The Service does not guarantee that generated code is production-ready, secure, or free of defects.
• Generation results may vary and the AI may produce different outputs for similar prompts.
• The Service may be temporarily unavailable due to maintenance, updates, or unforeseen issues.

6. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PROTOBERD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROTOBERD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion, with or without notice.

9. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. We will make reasonable efforts to notify users of significant changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from or relating to the Service shall be subject to the exclusive jurisdiction of the courts of the UAE.
